Former Floyd County republican leader Bobby Stumbo's case will be heard by a grand jury. He is charged with sexually abusing a five year old boy. During a preliminary hearing Wednesday, a judge decided there is enough evidence to move the case forward. Former county republican leader Bobby Stumbo is trading the political battles for a courtroom battle, but not by choice. "Mr. Stumbo maintains his innocence," Jerry Patton, Stumbo's attorney, said. Stumbo is accused of abusing a five year old boy. Police testified it all started when the boy returned home from his father's house and sat down with his mother. "He kissed her, and when he kissed her, he stuck his tongue in her mouth. She asked him where he learned that, and the child told her Bobby did that to him, talking about Bobby Stumbo," Detective Byron Hansford said. Police say Stumbo lives with the boy's father, but he was alone with the child at the time. Stumbo says he didn't do anything except get caught in custody battle between the parents. The judge disagreed and believes there is enough evidence to move forward. The Floyd County Attorney's office says they are ready for the fight in court. "The county will pursue this case very vigorously. Obviously,
there's a child involved and children are not able to speak for
themselves, so our office will see their voice is heard in the courtroom," Stacy Marshall said. Stumbo is out of jail, but he is not allowed within one thousand feet of the five year old boy. Police say their investigation is still ongoing and the Children's Advocacy Center is assisting in the investigation.
